Supplementary information from the BMF:
Residential premises" are buildings or parts of buildings that are primarily used for residential purposes, including other independent rooms and other parts of the property (such as cellar and attic rooms, parking spaces and gardens that are typically allocated to residential premises).
Buildings or rooms in buildings serve residential purposes if they are intended to enable private living, especially overnight accommodation, in self-contained rooms. The exemption covers not only the letting or transfer of use of the actual living space, but also ancillary rooms that are also let, such as cellar and attic rooms. A parking space or garden that is rented out together with the living space (i.e. in the same contract) is also considered to be rented out for residential purposes unless it is used predominantly for other purposes. Predominant use for residential purposes is deemed to exist if the amount of space used for residential purposes exceeds that used for other purposes.
